General Terms and Conditions, Ground Regulations and StalyFest Ticket Terms and Conditions of Stalybridge Celtic Football Club Limited
A. General Terms and Conditions
1. General
These Terms and Conditions form part of the contract between Stalybridge Celtic Football Club Limited (hereinafter "Organiser") and the purchaser (hereinafter "End Customer") of access rights, participation rights, admission rights, visitation rights or reservations and coupons for the foregoing or similar or related rights (hereinafter "Tickets") or other products or services (such as merchandise) (together “Offers”), which the Organiser may provide using technology platforms, software and services operated by Justtikit UK Limited (hereinafter "Justtikit"). “End Customer,” as that term is used herein, includes also individuals and legal entities who have not purchased Tickets or other Offers directly from the Organiser, but are entitled to participate in an event (such as through resale of Tickets, where permitted).
The Organiser hereby informs the End Customer that Justtikit, together with its affiliated companies, is a provider of technology platforms, software and services (hereinafter "Justtikit Services"), which are used by the Organiser to sell Tickets and provide Offers for association football, artistic, cultural, athletic or other events, theatre plays, concerts, meetings, seminars, leisure and other events, museums, historic sites, cinematic exhibitions, operas, lectures, conferences, continuing educational events, educational courses and other events and performances (whether physical or virtual) (hereinafter, each an "Event") and to sell Tickets, market other offers and process transactions related to Events to End Customers. Justtikit is a technology platform provider to the Organiser under license. Justtikit is not a ticket broker and is not the Organiser of any Event.
2. Contract
There is no contract between Justtikit and the End Customer. Upon the successful completion of a purchase transaction between the Organiser and the End Customer using the Justtikit Services, a contract will exist between the Organiser and the End Customer only, notwithstanding the fact that Tickets or Offers may contain statements such as "powered by Justtikit" or similar designations, and notwithstanding that the Organiser advertises, offers and/or distributes the Tickets or Offers via the domains and sub-domains of Justtikit (e.g., Justtikit.com). No purchase, services or other agreement is concluded between the End Customer and Justtikit.
The End Customer acknowledges that the Organiser may make the sale of Tickets and other Offers subject to the acceptance of further conditions, data protection declarations, instructions for cancellation and other contractual components by the End Customer and other restrictions (such as maximum number of Tickets for an Event). The Organiser or Justtikit (on behalf of the Organiser) shall be entitled to refuse or reject the conclusion of purchase transactions with the End Customer for any legal reason.
The End Customer acknowledges that the total purchase price of Tickets and Offers shall be determined or modified solely by the Organiser or third parties who sell to or through the Organiser. The total purchase price may exceed the ticket price indicated on a Ticket or in the Organiser’s ticket storefront. The calculation of the total purchase price shall be based on the indicated ticket price with the addition of any markup, fees, surcharges and taxes. The End Customer shall be notified of the total purchase price to be paid by the End Customer before the completion of the purchase transaction. Payment of the total purchase price can only be made by the payment methods provided by the Organiser or Justtikit (on behalf of the Organiser).
The contract between the Organiser and the End Customer for the purchase and sale of Tickets or Offers shall deemed completed only when the Organiser or Justtikit (on behalf of the Organiser) has confirmed the transaction with the End Customer (e.g., by providing the transaction confirmation or by the assignment and subsequent transfer of a Ticket with the corresponding ticket ID). The completion of the ordering process, without such confirmation, such does not constitute a binding contract and does not entitle the End Customer to participate in an Event.
If Ticket quotas (both the total quota for the Event and the quotas of individual categories of Tickets) have been exceeded due to technical issues, the Organiser or Justtikit (on behalf of the Organiser) shall notify the End Customer. The Organiser or Justtikit (on behalf of the Organiser) may revoke the corresponding Tickets with repayment of the corresponding total purchase price.
3. Form of Tickets
Unless otherwise agreed by the End Customer and the Organiser or Justtikit (on behalf of the Organiser), the End Customer will receive an automated email message from Justtikit (on behalf of the Organiser) to confirm the order and an additional email message with a link to the Tickets purchased for the corresponding Event. The form of the Tickets provided will depend on the method of admission entry utilized by the Organiser for a particular Event and will be communicated to the End Customer (such as by downloading and printing the Ticket, digital wallet or other options). To participate in an Event, the Ticket must be presented in the form provided. Presentation of the email for the order confirmation alone (without providing the Ticket in the correct form) does not entitle the End Customer to participate in an Event.
If the Organiser provides such option, the End Customer has the ability to order Tickets in printed form and shipped to the End Customer for an additional fee (hereinafter "Printed Tickets").
The End Customer is required to verify that the purchased Tickets are correct in terms of quantity, price, date, event, venue, and other essential details. Any complaint about incorrect Tickets must be reported to the Organiser or Justtikit (on behalf of the Organiser) promptly after the purchase, and in no event later than five business days following the End Customer’s becoming aware of the issue that is the subject of the complaint.
The transfer of ownership of Tickets or related rights to the End Customer shall only occur upon the full payment of the total purchase price and the settlement of all outstanding claims for payment from the End Customer to the Organiser.
The End Customer must provide truthful, complete and correct information as part of the purchase transaction. The Organiser or Justtikit (on behalf of the Organiser) shall be authorised to verify the information provided by the End Customer using appropriate legal means (such as credit reports when properly authorised).
4. Rights and Obligations
The Organiser or Justtikit (on behalf of the Organiser) shall communicate all relevant requirements regarding an Event, Tickets or other Offer (such as the scope or content, place, time, Organiser, price, fees and taxes, requirements and restrictions on participation, access controls, form of Tickets to be presented, accessibility, venue plan, house rules and other codes of conduct for the respective venue and other restrictions or essential information that could reasonably affect the End Customer’s decision to purchase).
The End Customer hereby acknowledges and agrees to such requirements, which are part of the contract between the Organiser and the End Customer.
It is the sole responsibility of the End Customer to verify his or her capability and/or willingness to meet the requirements communicated by the Organiser. The Organiser may refuse or terminate the participation of an End Customer in an Event upon non-compliance with such requirements.
If the Organiser or Justtikit (on behalf of the Organiser) reasonably suspects abuse or legal violations (including legal violations of these General Terms and Conditions or other applicable terms of the contract between the Organiser and the End Customer), such as through fraudulent, illegal or breach of disloyal activities or of corresponding circumvention or attempts to circumvent such provisions and conditions, the Organiser or Justtikit (on behalf of the Organiser) may revoke the validity of a Ticket without compensation before or during an Event and deny the End Customer the right to participate in an Event or remove the End Customer from the Event.
If Tickets are damaged, lost or stolen, the End Customer must notify the Organiser and Justtikit without delay. If the End Customer loses a Ticket, the Organiser or Justtikit shall not be obligated to provide a replacement.
Unless otherwise agreed, the validity of a Ticket shall be restricted to the respective Event (in particular, in terms of time and place) and, if necessary, the respective seat or seat unit or the corresponding ticket category. The Ticket shall become invalid once the Event has ended.
The End Customer acknowledges that Justtikit has no obligation to instruct, verify or supervise the Organiser regarding its obligations to End Customers for Tickets, Events and other Offers made by the Organiser, which are offered and processed via Justtikit Services. The Organiser is solely responsible for the communication, publications and information, and Justtikit does not bear responsibility in that regard. Justtikit has no obligation to instruct, audit or supervise the Organiser in relation to its obligations towards End Customers. Further, Justtikit has no obligation to check the timeliness, correctness or completeness of the Organiser’s published communication and information. This applies even if employees of Justtikit act on behalf of the Organiser or if the Organiser uses contractual documents and templates provided by Justtikit.
Furthermore, the End Customer acknowledges that Justtikit does not guarantee uninterrupted accessibility and usability of the Justtikit Services. Justtikit does not bear any liability for delays or errors in the transmission, storage failures and associated limitations of the Justtikit Services. During maintenance work there may be temporary disruptions of the website and/or individual Justtikit Services.
5. Transfer of Tickets
Tickets may be transferred. To re-assign/personalise Tickets or any related identification information, please contact the Organiser. A processing fee may apply to this service.
6. Revocation, Cancellation, Refund, Return and Exchange of Tickets
In Case of no significant Changes, Postponement or Cancellation of the Event
There are no rights of revocation, return, cancellation or exchange of Tickets for Events, except were otherwise provided by applicable law, or permitted in the sole discretion of the Organiser. Subject to the foregoing, any purchase of Tickets is binding immediately upon completion of the purchase transaction (i.e., confirmation from the Organiser that the purchase has been completed) and cannot be cancelled.
In Case of significant Changes, Postponement or Cancellation of the Event
In the event of significant modification, postponement or cancellation of an Event due to circumstances for which the Organiser is not responsible, the End Customer shall be entitled to return the Tickets and shall be entitled to a refund for the price of the Ticket less any processing fees.
Justtikit shall process the exchange or refund on behalf of the Organiser. The refund will be made to the End Customer using a payment method selected by Justtikit (on behalf of the Organiser).
A modification shall be considered significant if the modified Event is fundamentally different from the Event that the Ticket purchaser reasonably expected.
7. Liability
Except where otherwise provided by non-waivable provisions of applicable law (e.g. in cases of breach of material contractual obligations, injury to life, body or health), the Organiser shall be liable only for intentional misconduct and gross negligence. Except where otherwise provided by non-waivable provisions of applicable law, liability for a slightly negligent breach of material contractual obligations shall be limited in amount to the transaction value related to the transaction giving rise to the liability. Subject to the foregoing limitations, the Organiser shall not be liable for damages due to force majeure or violations of obligations by third parties.
To the extent that the Organiser’s liability is excluded or limited herein, the foregoing limitation of liability shall also apply to the personal liability of the Organiser’s legal representatives and agents as well as any representatives acting for the Organiser with regard to the End Customer, including without limitation Justtikit and its affiliates, each of which representatives and agents is an intended third party beneficiary of the contract between the Organiser and the End Customer, with the power to enforce the contract as if a party hereto.
The End Customer hereby acknowledges and agrees that: Except as provided to the contrary by non-waivable provisions of applicable law, Justtikit shall have no liability to the End Customer when acting on behalf of the Organiser as an agent or otherwise. Justtikit shall not be liable for damages caused by force majeure or breach of duty by third parties.
To the extent that Justtikit’s liability is excluded or limited, this disclaimer or limitation of liability shall also apply to the personal liability of Justtikit's legal representatives and vicarious agents as well as any representatives acting for Justtikit with regard to the End Customer. Not in limitation of the foregoing, Justtikit shall not be liable for damages resulting from an Event’s failure, cancellation, modification, relocation or defect or the Organiser’s insolvency or loss or delayed arrival or defects in Printed Tickets as well as limitations in Justtikit Services.
8. Miscellaneous Provisions
These General Terms and Conditions shall take precedence over any provisions to the contrary in the contractual relationship between the Organiser and the End Customer.
The laws of the United Kingdom shall apply, and the United Nations Convention on the International Sale of Goods (hereinafter “CISG”) shall not apply. This shall not affect statutory provisions restricting the choice of law and the applicability of mandatory provisions.
Insofar as the End Customer is not a Consumer, the exclusive place of jurisdiction for all disputes between (i) the End Customer and the Organiser shall be the United Kingdom and (ii) between the End Customer and Justtikit shall be the United Kingdom.
The End Customer shall be deemed to be a “Consumer” insofar as the purpose of the ordered deliveries and services is not attributed to his commercial or self-employed professional activity. Any natural person or legal entity as well as partnership with legal capacity acting in its commercial or self-employed professional activity when concluding the contract shall not be deemed a Consumer. Furthermore, the End Customer shall not be deemed a Consumer when purchasing services in connection with leisure activities if the contract provides for a specific date or period of time for the provision.
If any of the preceding provisions are, or become, ineffective or unenforceable in whole or in part, such condition shall not affect the validity of the remaining provisions. The same shall apply if and to the extent that a gap or ambiguity exists, and an appropriate provision that comes closest to that which the Organiser and the End Customer would have wanted economically shall replace the affected provision, if they had considered that gap or ambiguity.
This site is controlled and operated by Justtikit from its offices in the United Kingdom. If there is any dispute about or involving Justtikit Services, by using Justtikit Services, you agree that the dispute will be governed and construed by English law. In the event of a dispute arising out of or relating to these terms and conditions, or your use of or access to Justtikit Services, litigation must be brought in court in London, England without regard to its conflict of law provisions.
B. Ground Regulations
These Ground Regulations shall apply to each Match taking place at the Ground. Entry to the Ground shall constitute acceptance of these Ground Regulations and the Rules and Regulations.
Definitions:
"Club" means Stalybridge Celtic Football Club.
"Football Authorities" means the Football League, the Premier League, The Football Association, the Football Association of Wales, the league of which the Club is in membership from time to time, FIFA, UEFA and any other relevant governing body of association football.
"Ground" means Bower Fold, Mottram Road, Stalybridge, Greater Manchester SK15 2RT and all locations owned, occupied or utilised by the Club.
"Ground Regulations" means these ground regulations, as amended from time to time.
"Match" means any association football match (or any part or aspect of such a match) taking place at the Ground.
"Material" means any audio, digital, visual or audio-visual material or any information or data.
"Rules and Regulations" means each of the rules and regulations of the Football Authorities that may be relevant to the Match, the Club and/or the Ground from time to time.
1. Entry to the Ground shall constitute acceptance of these Ground Regulations and the Rules and Regulations. All persons entering the Ground must have paid the relevant admission charge. Proof of age, where an age concession is claimed, and proof of identity may be required and must be supplied on demand.
2. Notwithstanding possession of any ticket the Club, any police officer or authorised steward may refuse entry to (or eject from) the Ground any person:
2.1 who fails (or in the Club's reasonable opinion is likely to fail) to comply with these Ground Regulations or any reasonable instruction issued by a police officer or authorised steward; and/or
2.2 whose presence within the Ground is, or could (in the Club's reasonable opinion), constitute a source of danger, nuisance or annoyance to any other person.
3. On no account will admission be granted to a person who is the subject of a current Banning Order under the Football Spectators Act 1989 (as amended) or has been convicted of ticket touting offences under the Criminal Justice and Public Order Act 1994 (as amended).
4. The Club excludes, to the maximum extent permitted by law, any liability for loss, injury or damage to persons and property in or around the Ground. Nothing in these Ground Regulations shall exclude the Club’s liability for death or personal injury caused by the Club’s negligence.
5. No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date, or at all, and the Club reserves the right to reschedule or cancel a Match without notice.
6. In the event of the postponement, cancellation or abandonment of the Match (or if the Match has, for any reason, to be played out of the view of the public), refunds (if any) will be made in accordance with the specific ticket terms and conditions applicable to your ticket purchase. The Club will have no further liability whatsoever, including (but not limited to) liability for any in direct or consequential loss or damage, such as (but not limited to) loss of enjoyment or travel costs.
7. All persons seeking entrance to the Ground acknowledge and agree to the Club’s reasonable right to search any person, and their belongings, entering the Ground and to refuse entry to or eject from the Ground any person refusing to submit to such a search.
8. Further, you may not bring into the Ground any sponsorship, promotional or marketing materials save in respect of official club merchandise and/or other football related clothing nor may you offer (either free or for sale by any person) any goods (including literature) of any nature without the express written approval of the Club.
9. The following articles must not be brought within the Ground – knives, fireworks or any other pyrotechnics, smoke canisters, air-horns, flares, weapons, dangerous or hazardous items, laser devices, glass bottles, glass vessels, cans, poles, any articles that are prohibited by the Rules and Regulations, and any article that might be used as a weapon and/or compromise public safety. Any person in possession of such items will be refused entry to (or ejected from) the Ground.
10. The use of threatening behaviour and/or foul or abusive language is strictly forbidden and may result in arrest and/or ejection from the Ground. The Club may impose a ban (including, but not limited to, a ban for one or more Matches) and/or the removal of season ticket(s) for any such behaviour.
11. Any act of victimisation as defined in the Equality Act 2010 or any act of discrimination by reason of ethnic origin, colour, race, nationality, religion or belief, gender, gender reassignment, sexual orientation, disability age, pregnancy, maternity, marital status or civil partnership, or other forms of harassment is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban (including, but not limited to, a ban for one or more Matches) and/or the removal of season ticket(s) for any such behaviour.
12. Nobody may stand in any seating area whilst play is in progress. Persistent standing in seated areas whilst play is in progress is strictly forbidden and may result in ejection from the Ground and, in addition, the Club may impose a ban (including, but not limited to, a ban for one or more Matches) and/or the removal of season ticket(s) for any such behaviour.
13. The obstruction of gangways, access ways, exits and entrances, stairways and like places is strictly forbidden. Nobody entering the Ground shall be permitted to climb any structures within the Ground.
14. With the exception of the designated smoking areas (if any), smoking (including the use of electronic cigarettes) is not permitted in any part of the Ground and will result in ejection from the Ground.
15. Mobile telephones, smartphones, tablets and other mobile devices are permitted within the Ground provided that they are used for personal and private use only (which, by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes).
16. Alcohol may only be consumed within the Ground if purchased from the Club’s own facilities and in accordance with the Club’s licensing conditions. Under the Sporting Events (Control of Alcohol etc) Act 1985 (as amended), the following are offences for which a person can be arrested by a police officer and conviction could result in a Banning Order being made under the Football Spectators Act 1989 (as amended):
16.1 Attempting to enter the Ground or being inside the Ground whilst drunk;
16.2 Being in possession of any intoxicating liquor, or bottle, can or other portable container which could cause damage or personal injury, when entering the Ground or in a public area of the Ground from which the event can be directly viewed.
17. Under the Football (Offences) Act 1991 (as amended) the following are offences for which a person can be arrested by a police officer and conviction could result in a Banning Order being made under the Football Spectators Act 1989 (as amended): The list is non-exhaustive.
17.1 The throwing of any object within the Ground without lawful authority or excuse;
17.2 The chanting of anything of a racist, homophobic or discriminatory nature; and/or
17.3 The entry onto the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse.
18. Any individual who has entered any part of the Ground designated for the use of any group of supporters to which he does not belong may be ejected from the Ground either for the purposes of his own safety or for any other reason.
19. Save as set out in Regulation 15 above, no person (other than a person who holds an appropriate licence) may capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may they bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Copyright, database rights and any other intellectual property rights in any unauthorised recording or transmission is assigned (by way of present assignment of future rights) to the Club and the relevant Football Authority responsible for the Match. You further agree (if and whenever required to do so by the Club) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the Club and the relevant Football Authority responsible for the Match absolutely and with full title guarantee.
20. Tickets are not transferable and may not be offered for sale without the prior written permission of the Club or otherwise as set out in the express terms and conditions of such tickets. Any tickets offered for sale in breach of the terms and conditions thereof may be confiscated by any steward or officer of the Club or any police officer. The Club reserves the right to refuse admission to or eject from the Ground, any person who has transferred his/her ticket in contravention of the relevant ticket terms and conditions (and/or the holder of any ticket that has been transferred in contravention of the relevant ticket terms and conditions). In the event of any refusal of admission or ejection from the Ground no refund shall be payable. Tickets remain the property of the Club at all times.
21. By entering the Ground, all persons acknowledge that photographic images and/or video recordings and/or stills taken from those video recordings may be taken of them and may also be used by the Club for marketing or promotional purposes. Entry into the Ground is confirmation that all persons have consented to such use of their image unless the Club is notified in writing to the contrary. If any images should feature an individual prominently the Club will make reasonable efforts to gain the consent of that person before publishing such image. If such person is under 18 years of age, the parent, guardian, responsible adult who is accompanying them into the Ground shall be deemed to have provided consent on their behalf.
22. CCTV cameras are in use around and in the Ground and the Club may itself use or transfer to the police or any Football Authority any recordings for use in any proceedings, or for health, safety or security purposes. By entering the Ground, you consent to such use and transfer of CCTV footage.
23. At all times whilst present in the Ground, persons must comply with any and all reasonable instructions and directions of any steward or officer of the Club, any police officer or any officer of any other safety or security service. Failure to comply with any such instruction or direction may lead to the refusal of entry to, or the immediate ejection from, the Ground.
24. Any person found damaging or defacing the Ground may be prosecuted.
25. No re-entry to the Ground is permitted unless permission is given by an officer or a steward of the Club.
26. The Club reserves absolutely the right to refuse entry and eject from the Ground any person that fails (or in the Club’s reasonable opinion is likely to fail) to comply with any of the Ground Regulations or the Rules and Regulations or whose presence within the Ground is, or could (in the Club’s reasonable opinion), be construed as constituting a source of danger, nuisance or annoyance to any other person. This could lead to further action by the Club including, but not limited to, the withdrawal of any Club membership and or match ticket and/or season ticket (without reimbursement) and other benefits.
27. The Club reserves the right to make changes to any of these Ground Regulations from time to time.
C. StalyFest (the “Event”) Ticket Terms & Conditions
General
1. Your purchase of a ticket for the Event constitutes your acceptance of these Terms and conditions (“T&Cs”).
2. “StalyFest”, “Us”, “We”, “Our” means Stalybridge Celtic Football Club Limited Limited, the organiser of the Event, and/or its representatives, employees and sub-contractors.
3. We reserve the right to implement restrictions/conditions before and during the Event to ensure it is safe. You must comply with any and all instructions given to you by Event staff and stewards and you may be evicted without a refund if you fail to comply.
4. We reserve the right to refuse admission or to remove any person from the site, without refund, for reasons of public safety (including for crowd surfing or moshing, or failure to comply with any measures put in place to combat the spread of Covid-19), any unacceptable behaviour likely to cause damage, nuisance or injury, or for any breach of these T&Cs.
5. You must not enter the site if you believe that you may have been infected with Covid-19 and/or you are displaying symptoms of Covid-19.
6.Tickets are for the Event and any billed artists and attractions may be subject to change.
7. No trading or promotional activity is allowed within the site without Our prior written consent. Goods using unauthorised logos must be surrendered to Event staff.
8. By entering the site, you give your express consent to your actual/simulated likeness to be included for no fee within any audio or visual recording to be used in any media for any purpose at any time, including CCTV, filming by the police or security staff and/or for marketing.
9. No unauthorised buses, coaches or vehicles of any kind will be allowed on site and there are no parking or overnight accommodation facilities on site.
10. These T&Cs are subject to change from time to time in our sole discretion and We will notify you by posting the amended T&Cs to the Event website.
11. We shall have no liability for any loss, injury, illness or damage to any person or property sustained at the Event howsoever caused (including by Us and Our agents) in any circumstances unless caused as a direct result of Our negligence and that which cannot by law be excluded or limited. Any personal property brought to the Event is at your own risk.
12. These T&Cs are governed by English Law and any dispute arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the English courts.
Refunds
13. Refunds are only considered if the Event is (i) cancelled in full and not rescheduled (if the Event is partially cancelled your refund will be a proportionate partial refund) or (ii) materially altered which is a change (other than a rescheduling) which, in Our opinion, makes the Event materially different to the Event that ticket purchasers, taken generally, could reasonably expect. The following are not deemed to be ‘material alterations’: changes to the Event line-up; adverse weather conditions; changes to individual artists, bands or band members; curtailment of the Event where the majority of the Event is performed; and delays to starting a performance or the Event or (iii) by special exception determined by StalyFest in its sole discretion.
14. Refunds must be requested from the point of purchase, no later than three months after the Event.
15. Refunds of any booking fees per ticket or per order fees are subject to the terms and conditions of the point of sale.
16. Personal arrangements relating to the Event including, but not limited to, travel, subsistence and accommodation are at your own risk and We shall not be liable for any losses incurred from personal arrangements or wasted expenditure beyond the ticket refund.
Age Policy
17. No unaccompanied under 18s are allowed on site and all under 18s must be accompanied by an adult ticket holder aged 18 or over who must remain on site throughout the Event as the under 18-year-old’s guardian.
18. We do not act in any parental or supervisory capacity for under 18s on site. This does not affect our legal duties to any attendee in respect of, or obligation to comply with, any applicable laws including health and safety or licensing laws.
Tickets & Wristbands
19. It is prohibited to resell tickets for the Event.
20. Tickets purchased from unauthorised sources may be rendered invalid and admission refused.Only wristbands issued by the Event in exchange for a valid ticket are valid for entry. The ticket holder is responsible for their tickets until it is exchanged for a wristband and then responsible for their wristband for the duration of the Event.
21. Tickets must be exchanged for a wristband on first entry at a wristband exchange. No re-admission on tickets. Wristbands are strictly non-transferable and will be invalid if removed, tampered with, transferred or resold. Wristbands must be worn at all times for the duration of the Event.
22. Tickets must be valid, presented in full according to the authorised agents delivery methods and not altered or tampered with.
23. Tickets for this Event have a unique barcode which will be scanned on entry and if found to be duplicated, either in error or for fraudulent gain, only the first instance of the ticket scanned will be admitted regardless of original ownership. Customers may be prosecuted if found to have deliberately duplicated and resold tickets for fraudulent gain.
24. If you have obtained this ticket in breach of these T&Cs and/or if you breach any of these T&Cs then your ticket/wristband shall be void, and all rights conferred on you or evidenced by such ticket/wristband, shall be void. If you seek to gain entry to the Event using a void ticket or wristband then we reserve the right to refuse you entry or evict you from the Event and you may be liable to legal action for trespass. Void tickets/wristbands are non-refundable.
25. Tickets/Wristbands cannot be used as part of any marketing, media or sales promotion, without the prior written consent of StalyFest.
26. StalyFest will not issue duplicates for lost or stolen tickets or wristbands. Tickets &wristbands remain the property of StalyFest until the Event closes.
Security
27. StalyFest reserves the right to evict customers without refund, and/or refuse admission where the Event’s eviction policy is breached.
28. Searching is a condition of entry and you may be searched anywhere on site at any time by security and detection dogs.
29. Without liability to you, We shall be entitled to confiscate any item(s) which may reasonably be considered to be a weapon (or used as a weapon) or which may cause danger, offence or disruption to any other person.
30. Any person suspected of carrying illegal items or carrying out illegal activity may be handed over to the Police, refused entry or evicted from the site without a refund.
Damage/Losses
31. StalyFest does not accept any liability for personal or property damages, losses (including surrendered items) or injuries sustained at this Event - other than caused as a result of our negligence. Attendance at this Event is at your own risk.
32. We may prosecute you if you cause damage to the site, the site infrastructure, or cause harm to any other person at the Event and/or site.
Banned Items
33. Gas canisters, aerosols over 250ml, airhorns, fireworks, flares, glass, illegal substances, drugs, ‘legal highs’ – this includes Nitrous Oxide and associated equipment including balloons, unidentified substances, new psychoactive substances (NPS), illegal items, laser equipment/pens, megaphones, blowtorches, sky or ‘Chinese’ lanterns, petrol burners, sound systems, spray cans, tabards/high viz jackets, motorcycle helmets, personal drones, bags larger than A4 in size, cans, alcohol of any kind, camping equipment, firewood, disposable barbeques, campsite stoves, audio recorders, umbrellas, glass, inflatable loungers, open drinks (PERMITTED items include – sealed ** water / soft drinks 500ml or less and empty re-usable bottles of any size). If you need to bring specific food or drink or medication due to a pre-existing medical condition, please bring supporting medical evidence. **Bottles must be sealed and untampered or empty so that they are not used for bringing in alcohol to the site.
34. Under 18s are not permitted to bring alcohol or to purchase alcohol at the Event. A Challenge 21 policy will be in place for all alcohol sales on site. It is illegal for an over 18 to purchase alcohol on the behalf of under 18s.
35. Anyone resisting the surrender of disallowed items or disregarding these conditions will face eviction. Items that are surrendered or confiscated will not be returned.
36. No animals, other than guide or hearing dogs, are permitted on site.
Fire & Safety
37. Smoking is not permitted in enclosed public spaces or buildings including the spectator stands on site. This includes e-cigs/vaping.
38.Excessive exposure to loud music may cause damage to your hearing.
39. Pyrotechnics, lasers, smoke machines, strobe lighting/special effects may take place during some performances.
40. The use of drones or similar equipment for any reason is prohibited on or near the Event without written permission from StalyFest.
